the problem is not that this is happening and a lot of people were aware 
of it.
the problem is that it is most probably unconstitutional in most legal 
systems
where it is happening (well, the german constitutional court is not of 
my opinion, so the argument is
quickly thinner...) and since the constitutions are thin membranes 
between total control and usurpation of power
and  a semblance of some sort of representation (this concept has been 
eroded quite efficiently in most places
too), they are indeed the last line of defense.
legal and political systems have evolved with and adapted so much to 
total corporate and state surveillance that maybe the
only actionable answers lie in tactical countersurveillance, in deep 
exposure of the underlying mechanisms of
the surveillance architectures of the 21st century. this methods 
definitely have solid historical precedents.
i would not be so cynical and claim that everybody knew it and so what, 
lets check out.
this debate is long overdue and we should welcome it.
